Terms of service
Last updated: 14 October 2026 · Version 1
In short: 7brain is for businesses only. You decide which accounts you connect; 7brain reads only, as a rule, and changes something in your accounts only if you explicitly approve it. Analyses and recommendations are produced with AI and can be wrong – you make the decisions. Prices, term and cancellation are set out in your offer. Across companies, 7brain learns only abstract craft knowledge, and only if you agree. Swiss law applies.

1. Scope
These general terms and conditions (“terms”) apply to all contracts for the use of 7brain (website 7brain.wtf, app at app.7brain.wtf) between 7Cloud AG, Bahnhofstrasse 19, 9100 Herisau, Switzerland, UID CHE-468.091.118 (“we”), and the business that uses 7brain (“you”).
- Businesses only. 7brain is intended exclusively for businesses, in particular for people who run online shops. By entering into the contract, you confirm that you use 7brain for your commercial or independent professional activity and not as a consumer.
- Order of precedence. The following apply in this order: your offer or order confirmation, the Data Processing Agreement (DPA) for all data protection matters, and these terms. Your own terms and conditions do not apply, even if we do not expressly object to them.
- Staff. People you invite to 7brain use it on your behalf. You make sure they comply with these terms.
2. Services
- 7brain brings the data from your shop, your ad accounts and your email accounts together in one place, analyses it and gives you analyses, alerts, recommendations, tasks and reports – in the app and in the chat with Sevi.
- The exact scope of the services is set out in your offer or order confirmation.
- We develop 7brain continuously. We may change, replace or discontinue features if the agreed core of the service is retained and the change is reasonable for you. We will announce material restrictions in good time.
- We may use subcontractors to provide the service. Where they process personal data, the DPA applies.
- The services you connect (for example Shopify, Meta, Google, Klaviyo, TikTok, Pinterest, Slack) are not part of our service. Their providers are responsible for their availability, interfaces and terms. If a provider changes or blocks its interface, a feature may stop working temporarily or permanently; in that case we will try to find an equivalent solution.
3. Accounts and access
- You need an account to use 7brain. Keep your login details secret and do not pass them on. You invite other people yourself. If you notice or suspect misuse, let us know immediately.
- You connect services such as Shopify, Meta Ads, Google Ads, Klaviyo, TikTok, Pinterest and optionally Slack yourself. You warrant that you or your company are authorised to connect these accounts to 7brain and to have the data processed by us, and that doing so does not infringe the rights of third parties or the providers’ terms. If an account belongs to another company, you obtain its consent first.
- If you breach this warranty, you indemnify us against third-party claims arising from it, including reasonable legal defence costs.
- We store the access credentials for your accounts (for example access keys) encrypted in a dedicated vault. You can disconnect any connection at any time; see Data deletion for how.
4. Approval principle
- As a rule, 7brain connects with read-only access.
- 7brain makes changes in your accounts – for example to campaigns, budgets or email flows – only after your explicit approval. Without approval, 7brain changes nothing.
- If a change requires write access, you grant it yourself with the provider concerned. You can revoke it there at any time.
- By approving, you make the decision. We carry out the approved change as it was shown to you. Every approval is logged.
5. AI and no guarantee of success
- Analyses, recommendations, alerts and texts are produced with AI models and automated evaluations. They can be incomplete, outdated or wrong, for example if provider data is missing, delayed or faulty.
- The results are decision aids. They do not replace accounting or legal, tax or financial advice. You make the decisions. Check important results before you act on them.
- We do not owe any particular commercial success. In particular, we do not guarantee revenue, profit, advertising success or any specific metrics.
- Your data is not used to train AI models.
6. Your obligations
- You provide accurate information and keep your contact details up to date.
- You use 7brain only lawfully and in accordance with these terms. You do not try to circumvent security measures, access other companies’ data, overload 7brain or – where permitted by law – reverse engineer it. You do not offer 7brain to third parties as your own product.
- You are responsible for the data in your connected accounts and for processing it lawfully. This includes informing your own customers in your privacy policy.
- You do not enter sensitive personal data (for example health data) in 7brain unless this is necessary for its use.
- You comply with the policies of the connected providers, in particular their advertising policies. You are responsible for the content, budgets and settings of your accounts.
7. Availability and maintenance
- We aim for high availability of 7brain. We only owe uninterrupted availability if it is expressly promised in your offer.
- We schedule maintenance for times of low use wherever possible. If planned maintenance noticeably restricts use, we announce it in advance.
- We are not responsible for disruptions outside our control – for example at connected providers, on the internet or due to force majeure.
- If the security of 7brain or of your data is at risk, we may temporarily block access. We will inform you without delay.
8. Prices, term and cancellation
- Prices, payment terms, term and notice periods are set out in your offer or order confirmation. Unless stated otherwise there, prices are exclusive of statutory VAT.
- If you do not pay despite a reminder and a reasonable grace period, we may block access until payment is made.
- Both parties retain the right to terminate for good cause, in particular in the event of a serious breach of these terms. Notices of termination must be given in text form; an email is sufficient.
- When the contract ends, access ends. We delete the data we have processed on your behalf within 30 days in accordance with the DPA; on request, we hand it over to you beforehand. Statutory retention obligations remain reserved.
9. Intellectual property and results
- 7brain – software, design, brand and knowledge base – belongs to us or our licensors. For the term of the contract, you receive a simple, non-transferable right to use 7brain for your business’s own purposes.
- Your data remains yours. We only receive the rights we need to run 7brain for you and – only if you agree – the rights under section 11.
- Results are yours to use. You may use, edit and publish the reports, analyses, recommendations, texts and tasks that 7brain creates for you, without time limit and also after the contract ends, for your business’s purposes. Where rights in the results arise with us, we grant you these rights of use.
- AI-generated results may not be protected by copyright. Before publishing them, you check them yourself, for example for trademark, competition and advertising law.
- We may freely use suggestions and feedback on 7brain to improve 7brain.
10. Data protection and confidentiality
- How we handle personal data is described in our privacy policy.
- Where we process personal data on your behalf, the Data Processing Agreement (DPA) applies. It forms part of this contract.
- 7brain does not store the names or email addresses of your customers.
- We treat all non-public information about your business – for example figures, strategies and content – as confidential, also after the contract ends. We do not sell data and do not pass it on for advertising purposes.
11. Learning across companies (only with your consent)
7brain learns from your data and decisions for your company. This knowledge stays in your account. In addition:
- Only with consent. Only if you explicitly agree may 7brain derive abstract craft knowledge from your use and use it for all companies. Without your consent, this does not happen.
- What is shared. Craft knowledge only: for example how email flows are built, how ad accounts are structured, how tracking is set up and how a funnel works.
- What is never shared. Brand-related content – the design of your ads, your messages, your tone of voice, your personas, your texts and images – as well as personal data and figures that would identify you or your shop.
- Anonymous and aggregated. The knowledge is anonymised and combined with that of other companies so that no conclusions can be drawn about you, your shop or your customers. It feeds into 7brain’s knowledge base, not into the training of AI models.
- You can switch it off. You can withdraw your consent at any time, without giving reasons, with effect for the future – by email to info@7cloud.ai or in the app, if it offers a setting for this. After that, no new insights from your use are included. Knowledge that has already been anonymised can no longer be attributed to you and remains in place.
12. Liability
- We are liable without limitation for damage we cause intentionally or through gross negligence, and wherever the law mandatorily requires it, for example for personal injury.
- Liability for slight negligence is excluded to the extent permitted by law. This also applies to our auxiliary persons.
- Except in cases of intent or gross negligence, we are not liable for decisions you make, even if they are based on results from 7brain; for advertising budgets, ad spend and their outcome, even after a change you approved; for lost profit, indirect and consequential damage; or for outages, changes or data loss at connected providers.
- Where we are otherwise liable, our total liability is limited to the fees you paid us in the twelve months before the event causing the damage.
13. Changes to these terms
- We may change these terms for objective reasons, for example new features, changes in the law or new requirements from the connected providers.
- We will notify you of changes by email at least 30 days before they take effect. If you do not agree, you can terminate the contract with effect from the date the changes take effect. If you do not terminate, the new version is deemed accepted; we will point this out in the notice.
- Purely linguistic corrections and changes that are solely to your advantage apply without notice.
14. Final provisions
- Swiss law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
- The place of jurisdiction is Herisau, Switzerland. Mandatory places of jurisdiction remain reserved.
- Amendments and additions to the contract must be made in text form; an email is sufficient.
- You may only transfer rights under the contract to third parties with our consent.
- If any provision is invalid, the rest remains valid. It is replaced by a provision that comes closest to its commercial purpose.
- These terms are available in German and English. In the event of any discrepancy, the German version prevails.
